The passing of the Community Land Act (CLA) in 2016 was a critical step towards recogni\u00adtion <\/span>and protection of customary and indigenous land rights in Kenya. Its imple\u00admentation will enable com\u00admunities to safeguard land and natural resources.<\/p>\n

However, to date only three communities that sub\u00admitted applications have re\u00adceived a title — all are undis\u00adsolved group ranches.<\/p>\n

The presumed prioritisa\u00adtion of undissolved group\u00a0<\/strong>ranches over former trust lands and unregistered community lands may be understandable, but remains deeply problematic.<\/p>\n

The undissolved group ranches were surveyed and mapped decades ago and a majority of them have constitutions and community registers required for the reg\u00adistration of community land under the CLA. This is con\u00adtrary to trust lands.<\/p>\n

The defunct county councils held in trust community lands that were never sur\u00adveyed, they did not put in place bylaws or communi\u00adty registers. In short, undis\u00adsolved group ranches are ‘low hanging fruit’ for the ministry; issuing them with titles requires less time and effort than supporting trust lands to register.<\/p>\n

The problem with this sin\u00adgular focus on undissolved group ranches is that it mani\u00adfests the continuous exclusion of communities living on former trust lands.<\/p>\n

This is outright violation of the spirit of the law and its principles of equity and inclusion. The law recognised that communities on former trust lands are at a disadvantage, and to rectify this inequity, an adjudication for trust lands was to be rolled out and concluded within three years of enacting the Act.<\/p>\n

By giving priority to what is easy over what is fair and lawful, the government has delayed the security of the most-vulnerable rural com\u00admunities in Kenya. Without formal tenure rights, com\u00admunities on trust lands are at risk of being evicted, not compensated in case of com\u00adpulsory land acquisition, or other external threats.<\/p>\n

The Ministry of Lands must facilitate the registration of all community land. This in\u00adcludes developing and im\u00adplementing a comprehensive plan to survey and map all for\u00admer unregistered community lands including trust lands.<\/p>\n

Deploy adjudication offi\u00adcers to all registration units while ensuring that community land registrars have resources to process registra\u00adtion applications on time.<\/p>\n

TENURE RIGHTS<\/h3>\n

The ministry should deploy paralegals or community support personnel to guide communities through pre\u00adparing registers, delineating boundaries and resolving conflicts with neighbouring communities.<\/p>\n

Delineation requires a participatory approach to resolve conflicts that may arise. Last\u00adly, the ministry must also re\u00adduce or eliminate costs and associated fees. High costs can impede registration.<\/p>\n

Communities should not have to wait any longer to secure their land.<\/p>\n

The spirit of the Constitu\u00adtion and the Community Land Act is to shift governance of community land to commu\u00adnities themselves.<\/p>\n

The Ministry must midwife this vision immediately and allow communities to enjoy the fruits of secure tenure rights now and for genera\u00adtions to come.<\/p>\n","protected":false,"gt_translate_keys":[{"key":"rendered","format":"html"}]},"excerpt":{"rendered":"
